ALICE – A man who claimed he couldn’t work because of back problems will serve a year and a half in federal prison for working as a grave digger while collecting disability checks.
Prosecutors say 59-year old Guatemozin Garcia plead guilty to fraud in August for receiving $148,043 in benefits from 2008 to 2013.
The case was handled in federal court as Garcia was receiving funds from the Social Security Administration.
Investigators found he was paid by several people to prepare gravesites and graveside funeral arrangements, but concealed all of that income as required by law. His work included using a tractor and shovel to dig graves, set up and take down of tents and chairs, plus laying out artificial grass for services.
In addition to the prison sentence, Garcia must also pay back all of the money he received from the federal government.
He’s out on bond right now until he voluntarily surrenders to serve his sentence with the U.S. Bureau of Prisons.
